I am humbly writing to seek clarification regard to eligibility of second Family Pension to Parent (mother) consequent on death of two different Government Employees i.e. her husband and her un-married son under AP Revised Pension Rules-1980,
The Government of India (Ministry of Personnel P.G.& Pensions Department of Pension & Pensioners’ Welfare) have been clarified vide O.M.No.1/11/2011‐P & PW (E) Dated: 30-11-2011 that, Family Pension admissible to a beneficiary in respect of employee/pensioner is not to be counted as income for the purpose of determination of eligibility for another family pension, which is admissible in connection with another deceased employee/pensioner. However, any other income/earning of the beneficiary under consideration will be counted towards income for deciding eligibility for family pension.
The 10th Pay Revision Commission of Andhra Pradesh 2014 is of the view that, the Family Pensioner who happens to be the mother of the deceased unmarried daughter should be allowed second Family Pension subject to total amount of both family pension not exceeding 50% of the maximum of the Master Scale, which was referred in a case by the Finance Department to 10th Pay Revision Commission with regard to admissibility of second Family Pension to a Family Pensioner on the death of unmarried daughter while working in the State
Government vide volume-1 chapter-XVII Pensionary Benefits para No:13.
In the view of above I humbly request you to Sir, kindly clarify that, the eligibility to a member of family under Category-II for granting of two family pensions consequent on death of two Different Government
Employees under AP Revised Pension Rules-1980 mentioned below,
My Mother who is already under receipt of Family Pensioner consequent on death of my father while in service on 1996, is have entitlement for grant of another family pension consequent on death of her unmarried elder son who was appointed in 1997 under compassionate grounds and died while in service on 2014.
Further it is to submit that, my family purely depending on the earnings of my brother when he was alive, after his death my family has received pensionary benefits like Gratuity, APGLI, GIS, EL’s and compassionate Appointment consequent on death of my un-married brother.
Hence I humbly request you to Sir, kindly clarify that, the eligibility of my mother who is under receipt of Family Pensioner for grant of another family pension consequent on death of her un-married elder son under Category-II.
(i.e.parents) as per AP Revised Pension Rules -1980.
