What is Family Pension?

Family pension is defined in Section 57 as a regular monthly amount payable by the employer to a person belonging to the family of an employee in the event of death because to help that family . While Pension and family pension are qualitatively different. The former is paid during the lifetime of the employee while the latter is paid on his death to surviving family members. However, in case of family pension, since there is no employer-employee relationship between the payer and the payee, therefore, it is taxed as ‘Income from Other Sources’ in the hands of the nominee(s). So, In respect of family pension, deduction u/s 57(iia) of Rs.15000 or 1/3rd of the amount received, whichever is less, is available.

Family Pension Rules in Telangana TS AP

Family Pension is payable to the survivors of Government servant in the event of death of the Government servant while in service and also after retirement from public service (vide Rule 50).
It is payable at the rate of 30% of the pay last drawn by the deceased employee. If the Government servant had rendered not less than seven years of continuous service, the rate of family pension payable to the family pension payable to the family shall be equal to 50% of pay last drawn and the amount so admissible shall be payable from the date of death of the Government for a period of seven years or till the date on which the government servant would have reached the age of 65 years had he been alive whichever is earlier.

TS AP Family Pension (Rules 50 of the AP RPR Rules, 1980)

  1. Family Pension is payable to the family of a Government servant who dies while in service or after retirement.
  2. And Family for the purpose of Family Pension means
Family Pension Category – I
  1. Wife / husband
  2. Sons/unmarried daughters including widowed/divorced daughters up to the date of his/her marriage/remarriage or till the date he/she starts earning or till the age of 25 years, whichever is the earliest
  3. consequently Sons/daughters who are physically/mentally disabled throughout their life subject to certain conditions
Family Pension Category – II
  1. Furthermore Unmarried/widowed/divorced daughters and parents who were totally dependent on the Government servant
  2. while he was alive where the deceased employee left behind neither widow nor child.
  3. When unmarried/widowed/divorced daughters and parents are alive the family pension shall be paid first to the widowed/divorced daughters
  4. and then to the parents. Furthermore, Father precedes mother

Note: Category II members are eligible only after exhausting all members in Category I.

  1. If the son or daughter is suffering from any disorder or disability of mind or physically crippled or disabled so as to render him unable to earn a living even after the attaining the age of 21 years, family pension is payable for life subject to certain conditions.

Calculation of Family Pension

While Family pension is calculate at two rates:

Enhanced Rate –

  1. Enhanced Rate of Family Pension is calculated at 50% of emoluments last drawn and in case of death after retirement, it is restricted to the pension admitted to the individual.
  2. The enhanced rate of family pension is payable for a maximum period of 7 years and not beyond the notional date on which the deceased would have attained the age of 65 years (Applicable only if service rendered is not less than 7 years)

Normal Rate —

  1. Normal Rate of Family Pension is calculate at 30% of the Emoluments last draw.
  2. Family Pension resulting in a fraction when calculate, is round off to the next higher rupee.

  2. namaskar Sir / Madam. I am second wife of deciesed service pensioner of GHMC. His first wife expired aftr his retirement. I was married by late Sri P.Shivaiah while his first wife was alive since, she deserted him and their two minor sons a long back. Further our marriage was not got registered in Sub Registrar office and declaration was given by my husband on stamp paper. My husband ‘s and his first wife’s two sons were looked after by me only till their employment and marriages. But, unfortunately my name is not mentioned in SR or DCRG declaration. I have submitted all required documents aong with Family Members Certificate and declaration of two major sons to the GHMC. I am not having any source of income to feed myself. More over I am living seperately and serviving at the mercy of them.

    Kindly let me no the ways and means of source to get my Family Pension under humanitarian grounds and guide me. for which act of kindness I shall remain ever grateful to you.

Good evening Sir / Madam. my father expired and also my mother was expired before my father death. my doubt is who is eligible for family pension, my details as My brother is expired and my sister is married, and i am the last son and my age is 44, so please inform me sir about i am eligible or not for my father pension.

  5. Anitha took divorces from her husband through court of law. Her father was a Govt. Employee and retired from Govt. Service. While he was drawing service pension under AP State revised pension rules 1980, he died. She was sanctioned his family pension considering that she was his divorced daughter. The question is whether she is entitled for receiving money from her divorced husband for her maintenance while she has been drawing family pension of her father.
